資格外活動許可

 

　「資格外活動許可」というものがあります。これは主に「家族滞在」や「留学」ビザの人が入管の許可を得てアルバイトできる制度です。原則週２８時間以内と決められています。風俗営業は除きます。

　「原則」というのは「留学」の場合、夏休みなど学校が長期休暇の間は、一日八時間以内／週四十時間以内に拡大されるからです。

　現実には、このルールを守らない留学生が多いです。日本での生活費や学費を稼ぐためには週二十八時間では足らないからです。学業を疎かにし、中には留学とは名ばかりで稼ぐことが目的の「偽装留学」もあります。

　しかし週二十八時間を大きく超えて働きながら、出席率もよく、いい成績で卒業する人もいます。おそらく寝る間も惜しんで勉学とアルバイトに勤しんでいるのだと思います。

　また、「風俗営業等を除く」という一文があるのですが、私はこれを職業差別だと考えています。バーやクラブでアルバイトして何が悪いんでしょうか。パチンコ店やラブホテルでアルバイトして何が悪いんでしょうか。

　学生アルバイトがいなければ外国人パブなどは経営していけません。それに風俗店は時給が高く、短時間で稼げるため、割りがいいと言えます。

　また、「家族滞在」の配偶者や子の場合も週二十八時間以内を守らない人が散見されます。これらは課税証明書の収入額で怪しまれます。そして入管の調査が入り母国へ帰らされています。

　市区町村へ給与支払報告をしない会社も意外と多く、そういったところでアルバイトしている場合は課税証明書に表れません。入管はそれでも実態をつかもうとしていますが、なかなかばれないケースも多いです。

　私は、「偽装留学」は論外ですが、ちょっとくらいのオーバーは別にいいんじゃないかと思っています。そして大幅にオーバーしていても、ちゃんと出席し立派に卒業するのであれば、大目に見てほしいと思います。貧しい国々から留学してきているのですから。
